Driving with a Suspended License

Driver’s licenses can be taken away for a number of reasons in Houston. When a driver’s license is suspended or revoked, that person’s right to legally operate a motor vehicle on public roads and highways is terminated, either temporarily or permanently.

If a person is stopped by a police officer while driving on a suspended license, several penalties can be applied. Some of those penalties may take place immediately while others can be assigned at a court date in the future.

Possible Texas Penalties

A license can be suspended for a DWI arrest, failure to pay traffic tickets or child support, driving related convictions and many other reasons. Getting caught while driving under a bad license can be punished with a citation or an immediate arrest and trip to jail. Repeat offenses can significantly increase any penalties for this offense.

According to the Texas Penal Code, the primary penalties are:

Legal Defenses for Driving with a Suspended License

Dealing with a charge of driving on a bad license usually involves dealing with the revoked driving privileges directly. For example, some drivers may qualify for an occupational license. This is a temporary driving permit that allows drivers to operate a vehicle for certain times during the day, usually during hours typically associated with work commutes. This type of license is usually issued for drivers charged with DWI.

After the suspension period elapses, a driver can file an application with the Department of Public Safety to have their license reinstated. A fine must be included with this application, usually in the amount of $125.

Drivers who have their license suspended may be able to contest the suspension in court. There is usually a short period of time in which to do this. An attorney can help gather and fill out the required paperwork and submit the completed forms to the correct authority within the required time.
